What if filing a missing return will result in more tax, penalties, and interest due? It is still best to file such a return anyway – for several reasons.
If you don’t file a return, the IRS may file a “Substitute for Return” (SFR – IRS link) on your behalf. Usually, the IRS will file the SFR as much in its favor as possible. Filing your own return will normally result in a lower tax liability, In addition, an SFR may prevent you from discharging your tax debt in bankruptcy. Also, you want to get your IRS issues resolved and want the IRS to be willing to talk. They will do this only after all missing returns are in.
